Lawyers are starting to ship their first AI-assisted tools.
A contract-review surface. A litigation timeline generator. A demand-letter drafting workflow. A client-intake helper. A document comparison tool. A research assistant for a narrow practice area.
The response tends to split into two unhelpful camps.
One side treats the tools as proof that lawyers can now build whatever they want. The other side dismisses the work as not real software, not real engineering, not serious.
Both reactions miss the point.
The capability is real. The professional floor is real too.
To the lawyer-builders
Build.
The fact that you can now produce something that used to require a development team is meaningful. The impulse to make rather than wait for a vendor is the right impulse. Legal work is full of scaffolding that lawyers understand better than outside product teams do, and AI-assisted building gives those lawyers a new way to turn workflow knowledge into tools.
The work is not fake. It is not merely play. It is not automatically unserious because a foundation model helped produce the code or the workflow.
I have spent fifteen years building software, explored legal technology for years before launching FlowCounsel, and worked on AI infrastructure since 2018. I have watched the same compression hit engineering from close range. AI did not eliminate the judgment that makes a senior engineer valuable. It compressed scaffolding: boilerplate, glue code, standard patterns, first drafts, small workflows, routine debugging.
The same shape is arriving in legal.
Document assembly, discovery organization, standard-form drafting, intake classification, deadline tracking, and matter organization will compress. The judgment built from handling real matters will not.
When lawyers build tools that compress scaffolding, they are doing something real.
To the skeptics
Do not reduce what they are doing to "not real building."
That reduction is usually a professional-tribe move. Engineers use it against lawyers. Lawyers use it against engineers. Both are trying to protect a boundary by pretending the other side has no legitimate capability.
That boundary is wrong.
A lawyer directing an AI system to produce a working tool is building. The tool may be fragile. It may be incomplete. It may not be production-ready. It may need engineering review before it touches client data. But the activity is still building.
Do not deny the capability. Ask what floor applies when the tool moves from demo to real work.
The floor
Because the work is legal, the floor is higher than "it works on my laptop."
That floor includes technology competence, confidentiality, supervision, security, data handling, malpractice exposure, and review before external effect.
ABA Model Rule 1.1 Comment 8 has treated technology competence as part of professional competence since 2012. ABA Formal Opinion 512 extends that obligation into generative AI use. The combined architecture lesson is the same one discussed in ABA 512 and Heppner together: legal work needs systems that make review, confidentiality, and professional judgment enforceable rather than aspirational.
That does not mean lawyers should stop building.
It means the professional floor travels with the work.
What that floor looks like
If a tool is going to touch a live matter, client information, or external legal work product, the first questions are operational.
Where does the data go? If a user types a client's name, facts, medical records, contract terms, or litigation strategy into the tool, where does that information travel after it leaves the browser? Does the model provider retain it? Does the hosting provider log it? Does the application store it? Who can read it? How is access revoked?
What happens when the tool is wrong? If it produces a subtly wrong deadline, summary, clause analysis, or demand paragraph, where would the workflow catch the error? If the answer is "the user will probably notice," the tool is not ready for unsupervised use in real work.
What obligations travel with the output? If the tool drafts a letter, the lawyer who sends it owns the content. If it produces research that informs a filing, the lawyer signing the filing owns the work. AI-assisted generation does not move professional responsibility out of the lawyer's hands.
What does your state require? Some states have AI guidance. Some have not. Some issues are governed by general competence and confidentiality duties rather than AI-specific rules. Either way, knowing the governing standard is part of competent deployment.
What does your malpractice carrier think? If a tool is going into live client work, the answer should not be guessed after a claim. Ask the question before deployment, not after.
These are not anti-builder questions. They are the normal questions that apply when software touches consequential work.
Internal first, external later
The safest learning path is not complicated.
Start with internal tools.
Use AI-assisted workflows to organize your own notes, summarize materials you will verify, structure research you already understand, classify intake for your own review, or generate drafts that cannot leave the firm without human approval.
Those tools still need care, but the risk is different from a public-facing tool that collects client data or an external-facing workflow that produces a letter, filing, or legal conclusion.
The speed that produces the demo is not the speed that safely runs in production.
Do not stop. Sequence the work.
The blurring is real
The lines between professions are blurring.
Engineers ship compliance tools that shape how regulations are applied at scale. Lawyers build software that touches live matters. Accountants sit between finance, compliance, and automation. Legal-aid leaders are evaluating workflow infrastructure that may determine whether clients reach the right help at the right time.
That blurring is mostly good. It moves capability closer to the people who understand the work.
But the professional floor does not blur just because the crafts do.
A lawyer shipping software still carries lawyer obligations. An engineer shipping legal tooling still has to respect the legal consequences of the workflow. A legal-aid tool still has to route carefully, source its legal information, and hand off to human help when the situation requires it.
The obligations stack. They do not cancel out because the tools are new.
Build. And draw the lines.
The capability is real. The excitement is appropriate. The legal profession is better off when lawyers learn to build and when builders learn enough about legal work to build responsibly.
The lines that matter are not the old professional-tribe lines.
The lines that matter are about what you ship into a live matter, whose data is in it, what happens when it fails, what sources support its output, and what professional obligations travel with the result.
Build.
And draw the lines where the work actually requires them.
